These General Terms and Conditions (GTC) govern transactions between SpareSpot (operated by Arthur Cousin, hereinafter "SpareSpot") and any user (hereinafter "the User") wishing to rent or list a space through the SpareSpot platform.
Use of SpareSpot is reserved for individuals aged 18 or over and for legal entities duly represented. By creating an account, you confirm that you meet these requirements. SpareSpot reserves the right to refuse or suspend any account that does not comply.
SpareSpot is a marketplace that allows owners (hereinafter "Hosts") to offer spaces (parking spots, storage units, garages, etc.) for rent, and tenants (hereinafter "Tenants") to book them.
By publishing a listing, you grant SpareSpot a non-exclusive, royalty-free, worldwide licence to store, display, and reproduce your listing content (photos, title, description) solely for the purpose of operating the platform. This licence ends when you delete the content or close your account.
Users may not: publish false, misleading or fraudulent listings; list spaces they do not own or for which they lack the required authorisations; send spam or transmit malicious content; or engage in harassment, abuse or discrimination toward other users. SpareSpot reserves the right to remove any listing and suspend or permanently ban any account that violates these rules.
Prices are quoted in CHF. SpareSpot does not process payments and does not charge a commission. Payment arrangements are agreed directly between the owner and the tenant.
The applicable cancellation policy is the one defined by the Host and displayed on the listing. As SpareSpot is not a party to the financial transactions between Hosts and Tenants, it cannot be held liable for disputes relating to payments or refunds between the parties. In the event of a dispute, the parties are encouraged to seek an amicable solution before initiating any legal proceedings.
SpareSpot acts as an intermediary and cannot be held liable for material or physical damage occurring in the rented spaces. Hosts are responsible for the accuracy of the information published and for the compliance of their spaces. To the extent permitted by law, SpareSpot's aggregate liability for any claim arising from use of the platform is limited to CHF 500. This limitation does not apply in cases of gross negligence or wilful misconduct by SpareSpot.
These GTC are governed by Swiss law. Any dispute shall be submitted to the courts of the canton of Vaud (Lausanne).
